Consumer Reports & Background Screening User Agreement

This Consumer Reports and Background Screening User Agreement (“Agreement”) is entered into by and between Elite PI Services, LLC (“Elite PI,” “we,” “us,” or “our”) and the individual or entity (“User,” “you,” or “Client”) requesting background screening, investigative, or consumer reporting services.
By clicking “Yes, I agree”, submitting a screening request, or otherwise using Elite PI Services, you acknowledge that you have read, understand, and agree to be bound by this Agreement.
1. Purpose of Services
Elite PI Services provides background screening, investigative, and consumer reporting services, which may include but are not limited to:
Criminal background checks (local, state, federal)
Identity verification
Employment and education verification
Motor vehicle record (MVR) checks
License and credential verification
Address history
Other permissible investigative consumer reports
All services are provided in compliance with the Fair Credit Reporting Act (FCRA), 15 U.S.C. §1681 et seq., and applicable state and federal laws.
2. Permissible Purpose Certification
By using Elite PI Services, you certify that:
You are requesting consumer reports only for a permissible purpose under the FCRA, including but not limited to:
Employment, contract, staffing, volunteer, or independent contractor screening
Credentialing or compliance requirements
Tenant, licensing, or other legally authorized purposes
You will not use reports for personal, family, or household purposes
You have a legitimate business need for the information requested
Misuse of consumer reports may result in termination of services and legal liability.
3. Disclosure & Authorization Requirement
You certify that before requesting any consumer report:
You have provided the consumer/applicant with a clear and conspicuous written disclosure, in a standalone document, that a consumer report may be obtained
You have obtained the consumer’s written authorization
You will provide copies of disclosures and authorizations to Elite PI upon request
4. Adverse Action Compliance
If you take any adverse action (including denial of employment, termination, reassignment, or other negative decision) based in whole or in part on a consumer report, you agree to:
Pre-Adverse Action
Provide the consumer with:
A copy of the consumer report
A copy of “A Summary of Your Rights Under the Fair Credit Reporting Act”
Allow reasonable time for the consumer to dispute inaccuracies
Final Adverse Action
Provide an adverse action notice including:
Name, address, and phone number of Elite PI Services, LLC
Statement that Elite PI did not make the decision
Notice of the consumer’s right to dispute accuracy
Notice of the consumer’s right to obtain an additional free copy of the report within 60 days
5. Accuracy & Dispute Process
Elite PI Services follows reasonable procedures to ensure maximum possible accuracy. However:
Information is obtained from third-party sources
Elite PI does not guarantee completeness or accuracy of source data
Consumers may dispute information directly with Elite PI
Disputes will be investigated in accordance with FCRA timelines
6. User Responsibilities & Data Security
You agree to:
Maintain strict confidentiality of all consumer reports
Restrict access to authorized personnel only
Implement reasonable administrative, technical, and physical safeguards
Prevent unauthorized disclosure or misuse
Destroy consumer report information securely when no longer needed
7. Prohibited Uses
You agree NOT to use consumer reports:
In violation of federal, state, or local law
For discriminatory purposes
For credit, insurance, or personal decision-making unless legally permitted
To harass, intimidate, or retaliate against any individual
8. Limitation of Liability
To the maximum extent permitted by law:
Elite PI Services shall not be liable for indirect, incidental, consequential, or punitive damages
Liability is limited to the amount paid for the specific report in question
Elite PI is not responsible for decisions made by the User based on report content
9. Indemnification
You agree to indemnify, defend, and hold harmless Elite PI Services, LLC from any claims, damages, fines, penalties, or legal fees arising from:
Improper use of consumer reports
Failure to comply with FCRA or applicable laws
Inaccurate certifications or misuse of services
10. Termination of Services
Elite PI reserves the right to suspend or terminate access immediately if:
Misuse of reports is suspected
Legal or compliance risks arise
Required certifications are violated
11. Governing Law & Venue
This Agreement shall be governed by the laws of the State of Georgia, without regard to conflict of law principles. Venue shall lie exclusively in the state or federal courts located in Georgia.
12. Electronic Acceptance
By selecting “Yes, I agree”, you acknowledge that:
This Agreement is legally binding
Electronic acceptance constitutes a valid signature
You are authorized to accept this Agreement on behalf of your organization, if applicable
